Product images are provided for identification and general reference. Images may show optional equipment, accessories, vehicle configurations, or components that are not included.

Colors and finishes may appear differently because of lighting, photography, screen settings, manufacturing variations, or product revisions.

You are responsible for reviewing the complete product description before ordering.

7. Vehicle and Product Fitment

You are responsible for confirming that a product is appropriate for your vehicle and intended use before ordering or installing it.

Vehicle fitment may depend on:

• Engine and drivetrain
• Two-wheel-drive or four-wheel-drive configuration
• Cab and bed configuration
• Factory suspension or appearance package

Providing your vehicle information to Battle Born Offroad does not eliminate your responsibility to review the product application, manufacturer instructions, and final fitment before installation.

You should contact us before ordering if you are uncertain about compatibility.

8. Wheel and Tire Fitment

Wheel and tire fitment recommendations are estimates based on typical vehicle configurations.

Actual fitment may vary because of manufacturing tolerances, alignment settings, suspension height, tire construction, wheel specifications, vehicle weight, aftermarket components, and intended use.

A tire-size recommendation does not guarantee that the tire will be free from rubbing under every steering angle, suspension position, load, or driving condition.

Trimming, cutting, removal of factory components, wheel spacers, steering adjustments, suspension adjustments, or other modifications may be required.

You are responsible for confirming that the selected wheels and tires have appropriate load ratings, clearances, dimensions, and specifications for the vehicle.

9. Orders and Order Acceptance

Submitting an order is an offer to purchase the products or services listed in the order.

An order-confirmation email acknowledges that we received your order. It does not necessarily mean that we have accepted the order, confirmed inventory, or committed to a shipment date.

We may accept an order by:

• Sending a shipment confirmation
• Confirming that an item has been allocated
• Beginning fulfillment
• Submitting a special order to a manufacturer or supplier
• Providing the purchased service

We may refuse, limit, place on hold, or cancel an order when reasonably necessary, including when:

If we cancel an order after collecting payment, we will refund the amount collected for the cancelled portion, subject to applicable law and our policies.

We may limit quantities purchased by a person, household, account, payment method, billing address, shipping address, reseller, or distributor.

10. Pricing and Website Errors

Prices, promotions, availability, shipping offers, and product descriptions may change without notice before an order is submitted.

We make reasonable efforts to provide accurate information, but errors may occur because of typographical mistakes, supplier data, system problems, photographic errors, incorrect product feeds, or technical issues.

If an order contains a material pricing, availability, specification, or shipping error, we may:

Tax-exempt customers must provide valid and current exemption documentation before the order is processed. Tax exemption is not guaranteed until approved.

12. Payment Authorization

By submitting an order, you represent that:

An authorization or pending charge is not necessarily a completed charge.

For an extended-lead-time order, we may request renewed payment authorization or updated payment information before fulfillment.

We will not charge more than the amount you authorized without obtaining additional approval, except for adjustments permitted by applicable law or the payment provider’s terms.

You agree to promptly update payment and contact information when reasonably necessary to complete the transaction.

Nothing in these Terms waives your rights under federal or state laws governing credit cards, debit cards, electronic payments, billing errors, or unauthorized charges.

13. Financing and Installment Payments

Financing, installment payments, buy-now-pay-later services, and similar options may be provided by independent third parties.

Those services are governed by the provider’s separate terms, disclosures, eligibility requirements, privacy policy, interest rates, fees, and payment schedule.

Battle Born Offroad does not control credit decisions made by an independent financing provider.

A refund, cancellation, or return processed by Battle Born Offroad may take additional time to be reflected by the financing provider. You remain responsible for complying with the provider’s payment requirements until the provider confirms an adjustment.

14. Product Availability and Lead Times

Not all products displayed on the website are physically stocked at Battle Born Offroad.

Products may be:

• In stock at our location
• In stock with a distributor
• Shipped directly by a manufacturer or supplier
• Backordered
• Made to order
• Custom configured
• Subject to production or allocation schedules

Inventory changes frequently and is generally allocated on a first-come, first-served basis.

Lead times and estimated shipment dates are estimates, not guarantees. They may change because of production schedules, supplier availability, material shortages, carrier delays, weather, labor disruptions, or other circumstances outside our reasonable control.

When a shipment is delayed, we will provide any notice, consent opportunity, cancellation right, or refund required by applicable law.

15. Shipping, Freight, and Delivery

Orders are subject to our Shipping Policy.

Order-processing time is separate from manufacturer lead time and carrier transit time.

Shipping estimates are not guaranteed unless a guaranteed delivery service is specifically purchased and confirmed.

Products in the same order may ship separately and arrive at different times.

Oversized, palletized, heavy, or restricted products may require freight or less-than-truckload delivery. Additional charges may apply for residential delivery, liftgate service, limited-access locations, storage, re-delivery, or address correction.

You are responsible for providing a complete and accurate delivery address, email address, and phone number.

You must inspect deliveries promptly. Freight shipments must be inspected before the delivery receipt is signed. Visible damage or shortages should be documented on the carrier’s delivery receipt and photographed.

Shipping damage, shortages, missing items, and incorrect products must be reported within the period stated in our policies. This reporting period does not eliminate rights that cannot legally be waived.

Title and risk of loss will transfer as provided by applicable law and the terms of the applicable shipment.

16. Returns, Cancellations, Exchanges, and Refunds

Returns, cancellations, exchanges, and refunds are governed by the Return, Cancellation, and Refund Policy in effect when the order is submitted, except where applicable law requires different treatment.

Certain products may be non-returnable or non-cancellable, including:

• Custom-made products
• Custom-configured products
• Special-order products
• Installed or used products
• Opened electrical or electronic products
• Tuners and programmers
• Hazardous or restricted materials
• Clearance or final-sale products

Applicable restocking, return-shipping, re-boxing, freight, and cancellation fees will be disclosed in the Return, Cancellation, and Refund Policy or before the transaction is completed.

Nothing in these Terms restricts your right to reject goods, revoke acceptance, obtain a refund, or pursue another remedy when that right cannot legally be waived.

17. Installation

Unless expressly included in your order, installation is not included with an online product purchase.

Installation should be performed in accordance with the product manufacturer’s instructions and by a properly qualified person when specialized knowledge, tools, measurements, programming, alignment, welding, fabrication, or safety-system calibration are required.

Before installation, the customer or installer must:

• Confirm that the product is correct
• Confirm vehicle compatibility
• Inspect the product for damage
• Confirm that all components and hardware are present
• Review all instructions and warnings

A product that appears damaged, defective, incomplete, or incorrect should not be installed. Contact Battle Born Offroad before proceeding.

The customer and installer are responsible for:

• Proper installation procedures
• Required torque specifications
• Fastener rechecks
• Alignment
• Programming
• Calibration
• Inspection
• Maintenance
• Compliance with manufacturer instructions

Battle Born Offroad is not responsible for installation performed by the customer or an independent third party, except to the extent liability cannot legally be excluded.

18. Vehicle Modifications and Assumption of Risk

Aftermarket products may change a vehicle’s:

• Ride quality
• Steering response
• Handling and stability
• Braking characteristics
• Ground clearance
• Overall height and width
• Load-carrying capability
• Towing characteristics
• Fuel economy
• Noise and vibration
• Tire wear
• Maintenance requirements
• Driver-assistance and safety-system operation

Some modifications require additional components, inspections, adjustments, alignments, recalibrations, or ongoing maintenance.

Off-road driving, racing, towing, vehicle recovery, overlanding, and operation of a modified vehicle involve risks of personal injury, death, property damage, and vehicle damage.

You are responsible for using products and operating your vehicle safely, legally, within the capabilities of the vehicle, and within your experience and ability.

Nothing on the website instructs or authorizes you to engage in unsafe or unlawful conduct.

19. Safety Systems and Calibration

Vehicle modifications may affect factory systems, including:

• Airbags
• Electronic stability control
• Anti-lock braking systems
• Automatic emergency braking

Do not operate a vehicle when a modification has caused unsafe handling, unusual movement, warning lights, noise, vibration, interference, or other signs of improper operation.

20. Off-Road Products and Legal Compliance

Some products may be intended only for off-road, racing, competition, closed-course, show, or export use.

You are responsible for determining whether a product and its intended installation or use comply with:

• State law
• Local ordinances
• Emissions requirements
• Lighting requirements
• Noise restrictions
• Equipment standards
• Registration requirements
• Inspection requirements

The fact that a product is offered for sale does not mean it is legal for every vehicle, use, or jurisdiction.

Battle Born Offroad does not authorize or recommend the installation or use of a product in violation of applicable law.

21. Emissions Compliance

You may not use a product purchased from Battle Born Offroad to unlawfully remove, bypass, defeat, disable, or render inoperative a required emissions-control system or monitoring device.

You and your installer are responsible for confirming that an emissions-related product is lawful for the intended:

• Vehicle
• Engine
• Model year
• Jurisdiction
• Application
• Type of use

Products identified for competition or off-road use must not be installed or used on public-road vehicles when doing so would violate applicable law.

We may refuse or cancel a transaction that we reasonably believe would violate emissions or other applicable requirements.

22. Manufacturer and Vehicle Warranties

Products may be covered by a manufacturer’s warranty.

Manufacturer warranties are governed by the manufacturer’s terms, including their coverage, exclusions, documentation requirements, claim procedures, and available remedies.

Battle Born Offroad may assist with a manufacturer warranty claim but does not control the manufacturer’s decision or guarantee approval.

Unless expressly included in a written warranty, warranty coverage does not include:

• Removal or installation labor
• Diagnostics
• Alignment
• Programming
• Calibration
• Towing
• Storage
• Rental vehicles
• Loss of use
• Shipping
• Incidental expenses

The use of an aftermarket product does not necessarily cancel an entire vehicle warranty. However, a manufacturer, dealer, administrator, or service-contract provider may deny coverage for damage or failure it determines was caused by an aftermarket product, modification, improper installation, misuse, or insufficient maintenance.

Battle Born Offroad does not control vehicle-manufacturer warranty decisions.

Nothing in these Terms disclaims, restricts, or shortens an implied warranty or statutory warranty when doing so is prohibited by law.

23. Website Disclaimer

The website and its general informational content are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, timely, secure, error-free, or free of harmful code.

To the fullest extent permitted by law, we disclaim warranties relating solely to operation of the website, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

This website disclaimer does not replace or modify:

• A manufacturer’s written warranty

• An implied warranty that cannot legally be disclaimed

This section does not eliminate any cancellation, notice, refund, or other consumer right required by applicable law.

34. Suspension and Termination

You may stop using the website at any time.

We may suspend or terminate website access or an account if we reasonably determine that you have violated these Terms, engaged in fraud, threatened the security of the website, or created legal or operational risk.

Termination does not affect rights or obligations that arose before termination, including payment obligations, warranty rights, limitations of liability, intellectual-property rights, and dispute provisions.

35. Governing Law

These Terms and transactions with Battle Born Offroad are governed by the laws of the State of Nevada and applicable federal law, without regard to Nevada conflict-of-law rules.

However, this choice of law does not deprive a consumer of a mandatory protection provided by the law of the consumer’s state of residence when that protection cannot legally be waived by contract.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

36. Disputes and Venue

Before filing a legal action, you and Battle Born Offroad agree to make a good-faith effort to resolve the dispute informally.

A written dispute notice should include:

This venue provision does not prevent a consumer from filing an action in another location when the law of the consumer’s state requires that the action be permitted there.

These Terms do not require arbitration and do not waive a customer’s right to a jury trial or participation in a class action.

37. State-Specific Consumer Rights

Consumer-protection, warranty, privacy, shipping, refund, and commercial laws vary by state.

Any disclaimer, limitation, venue requirement, indemnity obligation, or remedy restriction in these Terms applies only to the extent permitted by the law applicable to you.

If your state gives you a right that cannot be waived, these Terms do not waive it.

Residents of states that restrict limitations on implied warranties or consequential damages may have additional rights.

Nothing in these Terms is intended to misrepresent, waive, or reduce rights available under an applicable state consumer-protection statute.

38. Severability

If a court determines that any provision of these Terms is unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

39. No Waiver

A failure or delay by Battle Born Offroad to exercise a right does not waive that right.
